Terms of Service
Effective date: October 7, 2026
These Terms of Service ("Terms") are an agreement between you and Jof Software LLC, a California limited liability company ("Jof Software," "we," "us"). They govern your use of the Westwind iPad application (the "App") and related services, including our servers and the westwindefb.com website (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Supplemental information only — the pilot in command is responsible
Before and during flight, you must verify all information provided by the Service, including weather, NOTAMs, temporary flight restrictions, airport and runway data, charts, procedures, airspace, terrain, obstacles, routes, distances, performance, fuel, and weight and balance. Verify it against current official sources, such as an official weather briefing, current FAA charts and publications, the Aeronautical Information Manual, and the aircraft's approved flight manual or pilot's operating handbook.
2. Not for navigation, collision avoidance, or terrain clearance
The Service is not a primary means of navigation. It must not be used as the sole means of navigation, collision avoidance, terrain or obstacle clearance, weather avoidance, or fuel management.
- Traffic displayed from ADS-B receivers is advisory only. It is not a traffic collision avoidance system (TCAS), does not show all aircraft, and must not be used for collision avoidance.
- Terrain, obstacle, glide-range, and nearest-airport information is advisory and does not account for all hazards.
- Position information depends on device sensors and external receivers, and may be unavailable or inaccurate.
3. No FAA approval or certification
The Service is not approved, certified, or endorsed by the Federal Aviation Administration or any other government agency. Jof Software is not affiliated with the FAA, NOAA, or the National Weather Service. If your operation requires operator or regulatory authorization to use an electronic flight bag, obtaining it is your responsibility.
4. Data currency and accuracy
Aviation data changes frequently. Weather, NOTAMs, temporary flight restrictions, charts, airport data, procedures, and other information in the Service may be delayed, incomplete, unavailable, or out of date. This includes when you are offline or have not downloaded the current data cycle. Downloaded data is current only for the cycle shown in the App. We do not guarantee the accuracy, completeness, or timeliness of any data.
5. Aircraft performance and weight and balance
Performance, fuel, and weight and balance figures are planning estimates. Reference data supplied for aircraft types is drawn from published sources, which are identified in the App, and has not been verified for your aircraft. You are responsible for entering and checking values for your specific aircraft. The aircraft's approved flight manual or pilot's operating handbook, and any approved supplements, always govern.
6. AI-generated summaries
Some briefing summaries are generated using a third-party AI model provider. These summaries are not official FAA or National Weather Service products. They may omit information or contain errors, and they are provided alongside the source observations and forecasts so you can check them. Do not rely on a summary without reviewing the underlying information.
7. Pre-release service
The Service is in pre-release development. Features may change, be suspended, or be removed at any time. We do not promise any level of availability or support. Flight plan filing is not currently available.
8. Eligibility
You must be at least 18 years old to accept these Terms. If you are between 13 and 17, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not intended for children under 13. The Service is offered only in the United States, and you are responsible for complying with all laws that apply to your use of it.
9. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. We and our licensors retain all rights not expressly granted.
10. Accounts
Some features require signing in with Apple. You are responsible for activity under your account and for keeping your device secure. You may delete your account at any time in the App. We may suspend or terminate accounts that violate these Terms.
11. Your contributions
If you submit fuel prices, comments, or other content ("Contributions"), you grant Jof Software a non-exclusive, royalty-free, worldwide license to host, store, reproduce, display, and distribute your Contributions to operate and provide the Service. You confirm that your Contributions are accurate to the best of your knowledge and that you have the right to submit them.
Contributions must not be false or misleading, defamatory, harassing, or unlawful, and must not include other people's personal information. We may review, decline, edit for formatting, or remove any Contribution at any time. Contributions reflect the views of their authors, not of Jof Software, and we do not verify them.
12. Acceptable use
You agree not to:
- copy, scrape, resell, or redistribute data obtained through the Service, or use it to build a competing data service;
- access our servers other than through the App, or interfere with, overload, or disrupt the Service;
- attempt to bypass security, rate limits, or access controls;
- reverse engineer the App, except to the extent applicable law expressly permits;
- use the Service in violation of any law or regulation.
13. Third-party data and services
The Service uses data and services from third parties, including the FAA, NOAA and the National Weather Service, the U.S. Geological Survey, Apple, and OpenStreetMap contributors.
- Aeronautical charts and data are from the FAA; Jof Software is not affiliated with or endorsed by the FAA.
- Airport surface map data is © OpenStreetMap contributors and is available under the Open Database License.
- Terrain data is derived from the U.S. Geological Survey 3D Elevation Program.
Third-party data is provided as is, and third-party services are subject to their own terms.
14. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DATA AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR CURRENT, OR THAT ANY DATA IS ACCURATE OR COMPLETE.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JOF SOFTWARE AND ITS MEMBERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR YOUR RELIANCE ON IT, INCLUDING ANY FLIGHT DECISION. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnity
You agree to indemnify and hold harmless Jof Software from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or from your Contributions, to the extent permitted by law.
17. Termination
You may stop using the Service at any time. We may suspend or end your access to the Service if you violate these Terms or if we discontinue the Service. Sections 1–6 and 11–20 survive termination.
18. Apple App Store terms
If you obtained the App from the Apple App Store:
- These Terms are between you and Jof Software only, not Apple. Jof Software, not Apple, is solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App. This includes product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any claim that the App infringes a third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Questions, complaints, or claims about the App should be directed to Jof Software using the contact information below.
19. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in California. You and Jof Software consent to the personal jurisdiction of those courts.
20. General
These Terms, together with our Privacy Policy, are the entire agreement between you and Jof Software regarding the Service.
- If any provision is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- We may update these Terms. We will post the updated Terms with a new effective date, and for material changes we will post notice on the Site and, where practical, in the App before they take effect. Continued use after the effective date means you accept the updated Terms.
